DOLLIVER, J.--RCW 4.24.010 authorizes parents to file a wrongful death action for the death of their minor child. In the case of an illegitimate child, however, the statute requires the father to have contributed regularly to the financial support of the child before the father can join in the action. The statute places no such contribution requirement on the mother of an illegitimate child. We find the support requirement violates Washingtons Equal Rights Amendment (ERA) (Const. art. XXXI, sec. 1).
